Is RTO Legal in California?
At-will rules, remote-work tax, unemployment safety net and official sources for California employees facing a return-to-office mandate.

RTO legality in California
Like most U.S. states, California is an employment-at-will state: absent a written employment contract, a collective bargaining agreement, or a specific anti-discrimination statute, your employer generally may decide where, when and how you work — including requiring you back in the office a set number of days per week. Being ordered back to the office is, by itself, legal in California.
What is not legal: using an RTO mandate to disguise discrimination (e.g., pushing out workers with disabilities, pregnant workers, caregivers, or older workers), retaliating against you for protected activity, or breaking a written remote-work commitment in your offer letter or union contract. Remote work may also be demanded as a reasonable accommodation under the federal ADA — an employer cannot simply refuse it without engaging in the interactive process. This page is general education, not legal advice; verify your facts against the sources below.
Labor-law highlights
California is at-will on paper but the most heavily worker-regulated state in the U.S.: meal and rest breaks, overtime rules, paid sick leave, pay-transparency law (SB 1162), and Cal WARN (60-day notice for mass layoffs at covered employers). Even so, California employers may generally require in-office attendance — your protection is in how the mandate is applied, not the mandate itself.
Remote-work tax notes
California taxes source income: residents are taxed on worldwide income, and nonresidents on income attributable to work performed in California. Working from home inside California for an out-of-state employer creates California-source wage income. California does not use the convenience rule, but its aggressive source-based enforcement is a known trap for remote workers crossing the border.
Unemployment & safety net
Unemployment and disability claims go through the EDD. California also runs a state disability insurance (SDI) program, which is relevant if you request an ADA-type remote accommodation for health reasons. Refusing RTO and losing your job is generally treated as voluntary leaving unless the conditions amount to constructive discharge.
