What is the convenience rule?

Normally, a state taxes income based on where the work is actually performed. The convenience-of-the-employer doctrine breaks that rule: if an employer's office sits in the state, and the employee works from home in another state for personal convenience, the state can still treat the pay as sourced to the employer's state — as if the employee had come into the office. The burden is on the employee to prove the remote location was required by the employer, not chosen by them. This is the legal mechanism behind most "I work from Florida but still owe New York tax" horror stories.

The convenience-rule states

StateApplies the rule? What it means for you
New YorkYes — the most aggressive enforcerNonresidents teleworking for NY employers owe NY tax on NY-attributed pay unless the home office serves the employer. New York challenges out-of-state remote setups routinely.
ConnecticutYesTelecommuters living outside CT but working for CT-based employers may owe CT tax on CT-attributed income.
DelawareYesApplies convenience-style sourcing to nonresident remote workers of Delaware employers.
NebraskaYesConvenience-based sourcing applies; nonresidents of NE with NE employers can owe NE income tax while working from home elsewhere.
PennsylvaniaYesPA taxes nonresidents on PA-source compensation, including remote work attributable to PA offices — interacts closely with NJ and NY.
ArkansasHistorically yes — repealedArkansas's remote-work payroll-tax measure was repealed/sunsetted; current law should be verified with the Arkansas Department of Finance and Administration.

Other states source income by where work is physically performed — no convenience rule. Texas, Florida, Washington, Nevada and Wyoming add no state wage tax at all. Rules change: verify against the state tax agency before filing.

Do you pay twice?

In practice the resident state almost always grants a tax credit for income tax you legitimately paid to another state, so the same dollar is rarely taxed twice in full. The real costs are: higher combined effective rates, complicated multi-state filings, employer registration friction, and under-withholding penalties when nobody sets the withholding up right. RTO mandates also interact here — if your employer ends remote work, the cross-state tax plan ends with it.

What to do

  • Run the Convenience Rule Checker to see whether your situation is flagged.
  • Get your employer to document, in writing, that the remote arrangement is required or approved (relocation, distributed team, written remote-work agreement).
  • Ask payroll whether you are registered and withholding correctly in both states.
  • File both state returns with a CPA who specializes in multi-state remote work.

FAQ — Convenience Rule States

What is the convenience rule?
It lets a state tax a nonresident's wages even when the employee works from home in another state — if the home office is for the employee's convenience, not the employer's necessity. It is the main cause of remote-work double-tax complaints.
Which states use the convenience rule?
Most commonly listed: New York, Connecticut, Delaware, Nebraska and Pennsylvania. Arkansas applied it historically but repealed the measure. Rules and exceptions change — verify with each state tax agency or a CPA.
Do I actually pay tax in two states?
Usually the resident state credits tax paid to the convenience-rule state, so no double taxation on the same dollar — but filings get complex and under-withholding penalties are common. A CPA should prepare both returns.
Can I avoid the convenience rule by working from home full time?
No — working from home full time is exactly what triggers the analysis. The escape is written proof that the remote location is required or affirmatively supported by your employer. A verbal "it's fine" does not count.
