RTO legality in New York
Like most U.S. states, New York is an employment-at-will state: absent a written employment contract, a collective bargaining agreement, or a specific anti-discrimination statute, your employer generally may decide where, when and how you work — including requiring you back in the office a set number of days per week. Being ordered back to the office is, by itself, legal in New York.
What is not legal: using an RTO mandate to disguise discrimination (e.g., pushing out workers with disabilities, pregnant workers, caregivers, or older workers), retaliating against you for protected activity, or breaking a written remote-work commitment in your offer letter or union contract. Remote work may also be demanded as a reasonable accommodation under the federal ADA — an employer cannot simply refuse it without engaging in the interactive process. Labor-law highlights
New York is at-will but layered with protections: statewide paid sick leave, NY WARN (90-day notice at covered employers), pay-transparency rules, and fast-food 'just cause' firing protections through the industry council. NYC employers commonly run the strictest RTO return mandates in the country — but they must still apply them without bias.
Remote-work tax notes
New York is the classic 'convenience rule' state. A nonresident who lives elsewhere but works remotely for a New York employer generally owes New York income tax on wages attributable to New York services, even if they never set foot in the office — unless the work-from-home location was required by the employer's convenience. New York also aggressively challenges out-of-state remote setups. Your employer must withhold New York tax and may need to register.
Unemployment & safety net
Unemployment claims go through the New York State Department of Labor. Quitting or being fired over an RTO order is generally disqualifying as voluntary leaving, unless you can prove constructive discharge or an illegal motive — New York DOL has specific hearing procedures you should understand before refusing.
