RTO legality in Texas
Like most U.S. states, Texas is an employment-at-will state: absent a written employment contract, a collective bargaining agreement, or a specific anti-discrimination statute, your employer generally may decide where, when and how you work — including requiring you back in the office a set number of days per week. Being ordered back to the office is, by itself, legal in Texas.
What is not legal: using an RTO mandate to disguise discrimination (e.g., pushing out workers with disabilities, pregnant workers, caregivers, or older workers), retaliating against you for protected activity, or breaking a written remote-work commitment in your offer letter or union contract. Remote work may also be demanded as a reasonable accommodation under the federal ADA — an employer cannot simply refuse it without engaging in the interactive process. This page is general education, not legal advice; verify your facts against the sources below.
Labor-law highlights
Texas is one of the strongest at-will states: there is no state paid-sick-leave mandate, no state mini-WARN (federal WARN applies only at covered employers), and limited wrongful-termination protections beyond statutes against discrimination. Expect employers to exercise RTO scheduling discretion broadly.
Remote-work tax notes
No state individual income tax at all. Whether you live in Texas, work remotely for a Texas employer, or telecommute into Texas from another state, Texas does not tax your wages — and Texas has no convenience rule. That makes Texas one of the most tax-friendly remote states, though you still owe tax in your state of residence.
Unemployment & safety net
Unemployment claims go through the Texas Workforce Commission. If you are fired for refusing an RTO mandate, you generally must meet the 'misconduct' test — quitting or being fired over a return-to-office order is usually treated as voluntary leaving, which is disqualifying, unless you can show constructive discharge or a protected reason.
