Remote Work Tax: California vs Texas远程工作税务:加州 vs 得州
Two of the most popular remote-relocation choices in America — and they tax you in almost opposite ways. Side-by-side comparison for 2026.

At a glance
The single biggest difference: California taxes your wages (top bracket above 10%), Texas does not tax wages at all. If you are a remote worker choosing where to live, the tax delta between the two can be worth tens of thousands of dollars a year. But California compensates with more worker protections (paid sick leave, SDI, Cal WARN), while Texas leans heavily on at-will employment. Neither state applies the convenience rule — that particular double-tax trap lives in the Northeast.
| Item | California | Texas |
|---|---|---|
| State individual income tax | Yes — progressive brackets, top rate above 10% | None — no state wage income tax |
| Remote-worker tax basis | Source-based: residents taxed worldwide; nonresidents taxed on CA-source work | No tax on wages regardless of where work is performed |
| Convenience rule | No — but aggressive source-based enforcement | No — moot, no income tax |
| Employer withholding / registration | Employer must withhold CA tax when work is performed in CA; may need CA registration | No state wage withholding to register |
| Live here, work for out-of-state employer | You owe CA tax (residence-based); check employer state too | No TX tax; check the employer's state rules |
| Paid sick leave | Statewide mandate (up to several days by employer size) | No statewide mandate |
| Mass-layoff notice (WARN) | Cal WARN — 60 days at covered employers (75+ employees) | Federal WARN only |
| Unemployment agency | EDD (runs state disability insurance too) | Texas Workforce Commission |
Who wins as a remote worker?
Moving from California to Texas to keep a remote job is the classic tax play: you keep the salary, drop the state income tax, and Texas has no convenience rule. The catch is that California is aggressive about auditing former residents — document your move (voter registration, driver's license, bills) and time it cleanly. Moving from Texas to California does the opposite: you add a state tax bill. Working remotely while staying put in California for a Texas employer simply means California taxes you — the employer's home state is irrelevant to that bill.
Important caveat
Salary bands for the same remote job often differ by where you live — California employers sometimes pay a "location adjustment" when employees leave the state. And RTO mandates can end your remote arrangement unilaterally: California employers generally may require in-office days, too.
